By registering for the World’s Best Incentive Program, you are agreeing to the following Terms and Conditions of the program:
· It is the responsibility of each participant to assure they have the approval of their manager and to participate in accordance with their dealership policies.
· Kenworth reserves the right to modify or terminate the program at any time for any reason.
· If dealer salesperson leaves dealership prior to vehicle retail, the incentive for that vehicle is forfeited.
· It is the responsibility of each participant in the Program to understand and comply with the Program Rules. Any violation may result in disqualification.
· Subject to applicable laws and regulations, Program Rules and decisions will be interpreted and administered by Kenworth at its sole discretion. Decisions by Kenworth will be final.
· All personal information is held strictly confidential and will not be shared with any parties outside of those facilitating this program. SSN and SIN numbers are used for tax reporting purposes only and are not used for credit checks.
· Federal Law requires that the value of all incentive rewards be reported to the proper taxing authorities. The value of rewards made to dealership employees for any incentive program or promotion will be reported to the individual reward winners and to the Internal Revenue Service (IRS) or Canada Revenue Agency (CRA) by Kenworth Rewards on IRS form 1099 (US) or 1042 (Canada). Persons receiving rewards will be responsible for applicable Federal State and Local taxes on the rewards and should consult with their tax advisor on questions regarding tax liability.
· Periodic e-mails will be sent to participants at the discretion of the Kenworth. Participants cannot opt-out of e-mails pertaining to the program but can unsubscribe to marketing materials. Participants can also opt-out of the Kenworth Incentive program at any time. Contact program management if you desire to opt-out of the Kenworth Incentive program.
· Rewards are issued on a Mastercard® prepaid card. You may use the Mastercard® prepaid card at millions of merchant locations, everywhere Mastercard® debit cards are accepted. Use this card at any ATM that displays the Mastercard® brand. ATM operator and/ or bank fees apply. This reloadable prepaid card will be mailed to the address specified at the time of registration or to the updated address in his/her profile at the time of card creation (prior to card load). See additional limitation and fee information included with card shipment.
· There is no APR (annual percentage rate) for these cards because the balance cannot go below zero and thus no "credit" is needed.
· You will receive your Kenworth Incentive program card approximately 7-10 business days after your first reward payment has been processed (generally in the month following goal attainment). You may access your real-time account balance 24 hours a day, 7 days a week by calling the number on the back of the card.
· Kenworth reserves the right to revoke the funds of any program participants who intentionally misuse the Kenworth Incentive program. No exceptions will be made to these rules.
· The program’s terms and conditions can change at any time at Kenworth’s discretion as Kenworth reserves the right to alter or cancel any part or this entire program at any time. All decisions and rulings made by Kenworth shall be final. All individuals participating in this program agree to abide by these decisions.
· Should any dispute arise regarding this Agreement which a Party determines cannot be settled by the Parties, the Parties agree that any and all actions brought to enforce the provisions of this Agreement shall be brought in a court of competent jurisdiction located in the State of Washington. This Agreement will be governed by and construed according to the laws of the State of Washington without consideration of any conflicts of laws principles.
